The Company will provide either a quotation for works, or the mechanism of fee calculation. This quotation along with these Terms and Conditions (T & Cs) form a contract between you and the Company. Agreement to a quotation or offer of work is deemed as acceptance of these T & Cs. Any queries regarding this should be directed to The Notary. If the Notary cannot carry out work requested by you, you will be notified from the outset and no contract between yourself and the Company will be formed.
A timeframe will be provided at the outset for the completion of works requested by you. Please note that this timeframe may be altered due to delays encountered by the Company from third party agencies such as the Foreign, Commonwealth and Development Office, Consulates or Embassies. We will strive to keep you updated on the progress of your works. Similarly, if additional fees are incurred, you will be notified of this.
Our preference is to take instruction in writing. We can also take instruction face-to-face or over the telephone. It is your responsibility to ensure that instructions and information provided are true, current and accurate. The Company bears no liability for mistakes caused by incorrect or incomplete information. The Company will always act on your instruction. The Notary will provide guidance, but decisions on your works must be made by you.
The Company is required by our regulator to verify the identification of each of our clients. You will be required to produce suitable photographic ID, preferably a passport, national ID card or driving licence, along with proof of address (utility bill, council tax bill, bank statement etc). If unsure, please consult the Notary for guidance.
You must provide evidence of your capacity and authority to sign documents. If signing on behalf of a company, the Notary may require articles of association, directors list, board resolution, company register or power of attorney.
The Notary must ascertain your mental capacity to sign. This will be done through a short interview to confirm that you understand what you are signing and are under no duress. The Notary reserves the right to request medical consultation with your consent.
The Notary is bound by law to prevent terrorism, money laundering, and criminal activity. Additional checks may be carried out. Suspicious activity will be reported to relevant authorities.
The Company provides legalisation services, including apostilles and embassy attestations. Quotes and timeframes will be provided at the outset. Third-party delays are outside our control.
A quote or fee mechanism is provided from the outset. If the information changes, fees may also change. Fees and disbursements must be paid before work is carried out unless otherwise agreed. The Company is registered for VAT. Work will not be released unless payment is received in full.
The Company reserves the right to refuse or cease work. You may cancel within 14 days unless you instruct us to act immediately.
The contract you make is with the Company. No claims may be made personally against directors, shareholders, consultants, or employees. Liability is excluded except for injury, death, fraud, or unlawful exclusions.
Your information is treated confidentially. Some information must be retained indefinitely by law. iNotary is registered with the ICO under ZB076789. Personal data is processed under GDPR principles.
If you are dissatisfied, please contact our team. If unresolved, complaints may be made to The Notaries Society, which provides a free approved procedure. Further escalation may be made to The Master of Faculties at the Faculty Office.
We hold professional indemnity cover of £1,000,000. Liability is unlimited for personal injury or death.
